What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal instrument which gives authority to another person (an attorney) to act on your behalf. There are two different types of Lasting Power of Attorney. One is for property and financial affairs and the other one is for health and welfare.

What options will I have when creating a Lasting Power of Attorney?

When creating a power of attorney, you can choose when you would like your attorney to act. For example, you may choose that they can act on your behalf as soon as the Lasting Power of Attorney is complete or you may choose that they can only act in circumstances when you cannot act.

Why is it important to have a Lasting Power of Attorney?

A Lasting Power of Attorney is very important as it allows for someone to be able to act on your behalf and deal with your affairs whether this is when it is created or only when you are not able to deal with your affairs.

A Lasting Power of Attorney can only be created if the person creating it has the mental capacity to do this. If you have any concerns regarding mental capacity, it is important that you act urgently to avoid a situation where the chance to create a Lasting Power of Attorney is lost due to losing mental capacity.

Can a Lasting Power of Attorney be cancelled?

A Lasting Power of Attorney can be cancelled as long as the donor has the mental capacity to do this. Cancelling a Lasting Power of Attorney is usually described as revoking a Lasting Power of Attorney.

What are the steps in creating a Lasting power of Attorney?

We have simplified the process to create a Lasting Power of Attorney so this can be done swiftly. There are a few simple steps to making your Lasting Power of Attorney;

  • We will send a client care pack to you which includes information about our company and an Instructions Form for you to complete and return
  • We will take copies of your ID documents and you can make payment for your Lasting Power of Attorney
  • We will contact you to discuss your requirements, provide advice and take instructions so you can choose the options you would like
  • We will prepare the Lasting Power of Attorney for signing
  • Once the Lasting Power of Attorney has been signed, we will send it to the Office of the Public Guardian for registration. Once the Lasting Power of Attorney is registered, you can start using it.

Home Visits

We offer home visits to accommodate you if you will struggle to visit us. As part of the process, we will usually visit your home twice to complete your Lasting Power of Attorney. 

On the first visit, we will provide you with our client care pack and assist you in completing our instructions form. On this visit we will discuss your requirements, provide advice and take instructions so you can choose the options that suit you.

We will then prepare your Lasting Power of Attorney and arrange a second visit. On the second visit, we will go over the Lasting Power of Attorney to make sure you are happy with everything in it. We will also supervise the signing of the Lasting Power of Attorney to ensure that it is signed and witnessed properly. Signing the Lasting Power of Attorney is an important step because if it is not done properly, the Lasting Power of Attorney will not be valid.
